Prenuptial Agreement

Many couples today are finding a Prenuptial Agreement to be useful before marriage.  Prenuptial Agreements do not,  in fact,  encourage divorce.  In reality,  such agreements lift some of the burdens off of the couple and leave the parties free to enjoy their marriage.

I will negotiate a Prenuptial Agreement on your behalf and prepare an Agreement that is clear,  understandable and valid in New York State.

Under the law,  marriage is considered to be a contract between the marrying couple.  The law also considers certain property rights for each individual in the marriage.

A Prenuptial Agreement allows you to decide for yourselves how your property should be handled.  Prenuptial Agreements can also be used to protect spouses from each other's debts.
Prenuptial Agreements are especially useful if one or both of you have children from a previous marriage or relationship.

The following are an example of the reasons people prepare Prenuptial Agreements:

  • You have children and/or grandchildren from a previous marriage

  • You have assets such as a home,  stock or retirement funds Own all,  or part of a business

  • You may be receiving an inheritance

  • One of you has considerably more income and/or assets than the other

  • One of you will be supporting the other through college

  • You have loved ones who need to be taken care of, such as elderly parent

  • You have or are pursuing a professional degree or license

  • You have certain assets or property that you wish to keep separate during the marriage

Prenuptial or Postnuptial  Agreement allows a couple to take control over your and your spouses property and assets.

When considering a Prenuptial or Postnuptial  Agreement it is important that you have skilled representation.  I have 27 years experience in Matrimonial Law.

* The costs for these services vary according to the facts and circumstances of each case.  Most pre and postnuptial agreements can be performed for a Flat Rate fee.  If you wish to retain this firm for representation,  please call my office at:  (607) 722-8272 or (888) 275-0877  where you will speak directly with me.

Postnuptial Agreement

A postnuptial agreement is basically the same as a prenuptial agreement,  except that you and your spouse enter into it during the marriage.

When you first get married you may not be thinking about long term financial planning.  Or during the marriage, your financial circumstances change.

A postnuptial agreement, like a prenuptial agreement can address the following issues,  among other issues;

  • Defining separate property

  • Defining marital property

  • Establishing maintenance

  • Establishing pre-marriage debt
