Father sought a modification of child support alleging he had lost his job.  The Court found that the Father had substantial investment assets, was receiving a pension, and interest and dividends from his assets.  The Court stated that &quot;...child support is not determined by parent's current financial situation but by his or her ability to provide support.&quot;

In the &lt;i&gt;Matter of Verrada v. Berrada, &lt;/i&gt;90 AD3d 1192 (3rd Dept 2001) the Court stated &quot;...it would not require children to subsidize a parent's financial decision.&quot;  The Father petitioned to modify his support obligation stating he was unable to find employment.  The Court found that the father had limited his job search, was attempting to start his own business and would only accept full time employment if it paid a substantial salary.</description>

In that case, grandparents petitioned the family court for custody of their grandchildren. Interestingly, the natural mother of the children consented to the physical placement of the children with the grandparents. The children lived continuously with the grandparents for over 30 months. 

In order for grandparents to gain custody of their grandchildren, they must show &quot;extraordinary circumstances&quot;. In this case, the Appellate Division stated that the placement of the children with the grandparents, even by consent does not constitute &quot;extraordinary circumstances.&quot; Therefore, for the grandparents to keep physical custody of the children they would have to prove &quot;...surrender, abandonment, persistent neglect, unfitness, disruption of custody over an extended period of time or other extraordinary circumstances&quot;.</description>
