Pensions and Retirement

A Qualified Domestic Relations Order is a document, signed by a Judge, which allows a pension company to give a spouse a portion of the other spouses pension benefits following a divorce.

Under Federal Law, pensions and other retirement plans are a protected asset and cannot generally be given to anyone other than the person who is entitled to receive the pension from their employer. One exception to this law allows one spouse to obtain a portion of the pension or retirement plan after a divorce, as part of a marital division of assets.

Either both parties in the divorce must agree to share the pension or a Court must decide that a pension is to be shared. Thereafter, a Qualified Domestic Relations Order (QUADRO) is drafted by an attorney. This order must comply with the conditions of the individual pension company or administrators.

I have prepared many of these QDROs following a divorce. This Order allows my clients to obtain their marital share of their spouses' pensions with private and public pension firms, including: New York State Electric and Gas, IBM, Lockheed-Martin, New York State Teachers Pensions, Public Employee Pensions and others.

I will prepare all the documents, obtain the appropriate judicial signatures and guarantee that the pension company administering your pension, or that of your spouse, will accept and implement the Qualified Domestic Relations Order.

Deed Transfers

A Deed Transfer occurs when one party wishes to transfer property to another party without an actual sale of the property. There are many situations where one party wishes to transfer title (or a portion of their title) to another without an arms-length sale (actual sale of the property). Some examples of transfers are transfers between former spouses or between family members. In these situations, there is no “sale” of the property and no money generally changes hands other than the legal $1.00 tender.

As part of the Legal Services that I provide in Binghamton, Broome County and the surrounding Counties, I will prepare all of the documents necessary to validly transfer property between family members and former spouses. The cost for preparing the documents is $ 150.00. The County Clerk's Office charges an additional fee for filing the papers. As the fees for filing deeds differ from county to county, we will submit to you the completed papers and you will file them at your County Clerk’s Office. I guarantee acceptance of your documents by the Clerk’s Office.

New York Will

A New York Will can ensure your desires are carried out in the event of death. A Will provides for the disbursement of your monetary and real property assets. If you have minor children, you can name a guardian for your children in your Will and make the necessary financial provisions to ensure their well being. If you do not have children as beneficiaries of your estate, you may wish to name other family members and/or friends as beneficiaries and even designate specific charities as beneficiaries.

I include with a Last Will and Testament a Living Will and a Health Care Proxy. A Living Will allows you to control your medical care in the event that you are unable to communicate your desires. A Living Will may include organ donations.

A Health Care Proxy allows you to name an individual or several individuals who will make your health care decisions in the event you are unable to make such decisions.

Lastly, I provide a set of instructions on how to prepare a list of documents that your family or friends will need to help them settle your estate at the time of your death.

I prepare only simple, direct Wills. I do not provide services for Estate Planning and I do not prepare Wills that include complicated trusts or extensive property bequests.

My office prepares Prenuptial Agreements. Many couples today are finding a New York Prenuptial Agreement to be useful before marriage. Prenuptial Agreements do not, in fact, discourage divorce. In reality, such agreements lift some of the burdens off of the couple and leave the parties free to enjoy their marriage.

I will negotiate a Prenuptial Agreement on your behalf and prepare an Agreement that is clear, understandable and valid in New York State.

I will protect your legal interests. Under the law, marriage is considered to be a contract between the marrying couple. The law also considers certain property rights for each individual in the marriage.

A Prenuptial Agreement allows you to decide for yourselves how your property should be handled. Prenuptial Agreements can also be used to protect spouses from each other's debts. Prenuptial Agreements are especially useful if one or both of you have children from a previous marriage or relationship.

The following are an example of the reasons people prepare Prenuptial Agreements:

  • You have children and/or grandchildren from a previous marriage

  • You have assets such as a home, stock or retirement funds

  • Own all, or part of a business

  • You may be receiving an inheritance

  • One of you has considerably more income and/or assets than the other

  • One of you will be supporting the other through college

  • You have loved ones who need to be taken care of, such as elderly parent

  • You have or are pursuing a professional degree or license

  • You have certain assets or property that you wish to keep separate during the marriage

  • Landlord Lease Agreements

    As part of my Binghamton Legal Services, I draft Landlord/Tenant Lease Agreements. My office can provide Landlords with a non-commercial, New York Lease Agreement.

    A Landlord who is renting non-commercial property should be protected with a Lease Agreement. A Lease Agreement can range in duration; week-to-week, month-to-month, yearly, or for several years.

    I will provide a clear, understandable and valid Lease Agreement for your rental property.
